Beta Participation Agreement
Draft. Written for the first group of beta testers and due for review by a lawyer before the beta opens to anyone outside that group. If it changes, you will be asked to read and agree to the new version before it applies to you.
What this is
HossTrain is not finished. By taking part in the beta you are using software that is still being built and tested, and you are helping find what is wrong with it. This agreement exists so that you know, before you start, what that can mean for you, your school and your information.
It sits alongside the HossTrain Terms of Service and Privacy Policy, which also apply. Where this agreement talks about what can go wrong, it is describing the state of the software honestly, not asking you to give up anything.
What “in development” means in practice
- Things will break. Expect bugs, crashes, screens that do not load, and features that behave wrongly or not at all.
- Information can be lost or recorded wrongly. That includes rosters, attendance, gradings, schedules, messages, documents and payment records. Keep your own copy of anything you cannot afford to lose. Do not make HossTrain the only place you keep signed waivers, emergency contacts, medical information or financial records during the beta.
- Numbers can be wrong. Assessment scores, form scoring, training load, nutrition estimates and other figures the app calculates may be inaccurate. Do not rely on them for decisions about safety, health or injury.
- Features change. Screens will move, features will be added and removed, and something you rely on may change without much notice.
- It may be unavailable, including in the middle of a class or a live video session.
- Updates will be frequent. You may need to update or reinstall the app, and test versions distributed through app store testing programmes can expire and need replacing.
Training and safety
HossTrain is a tool for running a school and supporting training. It does not supervise anyone, and it is not medical advice. Instructors remain responsible for how their classes are run, and anyone with a health concern should speak to a qualified professional. None of that changes because a feature is in beta, but it matters more while figures the app produces may be wrong.
If you run a school
- Your members will be using unfinished software too. When you invite them, tell them it is a beta. Each member is asked to agree to this agreement for themselves before they can download the app.
- The beta is open to people 18 and older. Please do not invite members under 18 to take part.
- You remain responsible for the information you put into HossTrain about your members, and for keeping your own records as described above.
Feedback
Reports of problems and ideas for improvement are what the beta is for, and they are welcome. We may use feedback to improve HossTrain without owing anything for it. We will not publish your name, your school’s name or anything you tell us in feedback without asking you first.
Keeping the beta within the beta
Please do not share beta codes, download links, or screenshots and video of unreleased features publicly. Places are limited, test versions are not ready for people who have not agreed to this, and a school’s own join code is for that school’s members.
Cost
Nothing is charged for taking part in the beta, and nothing starts charging without you agreeing to it first.
What we commit to
- Handle your information as the Privacy Policy describes, beta or not.
- Tell you promptly if we find a problem that has lost or exposed your information.
- Fix serious problems as quickly as we reasonably can.
- Give you a way to get a copy of your school’s information, and to have it deleted, if you ask.
- Give you notice before the beta ends or before anything you use stops being available.
Leaving
Taking part is voluntary. You can stop at any time. If you want your information removed when you leave, ask and we will delete it as the Privacy Policy describes.
What this agreement does not do
It does not ask you to give up any rights you have by law, and it does not excuse HossTrain from responsibility for its own negligence or from its obligations under privacy and consumer protection law. It is here to make sure you understand the risks of using unfinished software, not to shift those risks onto you.
Changes
If this agreement changes, the new version will carry a new date, and you will be asked to agree to it before it applies to you. The version you agreed to, and when, is recorded when you accept it.
